About
Seamus has advised insolvency practitioners, directors, creditors, and businesses on the intricacies of insolvency for more than a decade. His advocacy skills in dispute resolution matters are also well-recognised, with frequent appearances in the Supreme Court, Federal Court and other jurisdictions.
Seamus is a professional member of the Australian Restructuring Insolvency and Turnaround Association (ARITA) and has recently been appointed as a member of the disciplinary tribunal for Chartered Accountants Australia & New Zealand.
Experience
Seamus’ notable recent achievements include:
- a successful application to set aside a deed of company arrangement and remove voluntary administrators in circumstances where misleading information had been presented to creditors;
- co-authoring an article in the ARITA Journal which led to a reversal of the Australian Financial Security Authority’s long-held position that trustees in bankruptcy should refrain from paying their own remuneration until the petitioning creditor’s costs have been paid;
- successful outcomes in numerous voidable transaction claims for liquidators and trustees in bankruptcy; and
- obtaining an urgent injunction to restrain a vote relating to a significant proposed development from taking place in circumstances where it was alleged that misleading information had been sent to voters.
